
The Eleventh Circuit Court of Appeals affirmed in part an injunction preventing SB 7072 from going into effect. Last year, the Northern District of Florida issued an injunction, ruling that the law violated the First Amendment rights of social media companies. The appellate court, in large part, agreed and reiterated that social media companies have First Amendment rights. The court, however, lifted the injunction regarding the less “onerous” disclosure requirements.
In addition, the court rejected the state’s arguments that social media companies are common carriers.
